Terms & Conditions

    • Customers are referred to as “you” or “your”. La Gâterie SXM is referred to as “we”, “us”, “our”

    • We reserve the right to change these Terms and Conditions at any time. Any such changes will take effect from when they are posted on the website and it is your responsibility to read the Terms and Conditions on each occasion that you use this website and order with us. Ordering with us and continued use of the website shall signify your acceptance to be bound by the latest Terms and Conditions.

    • All orders must be made via WhatsApp and are subject to these Terms and Conditions.

    • Acceptance of your order is made once the order is confirmed by us in writing (by email or WhatsApp message) and payment has been made in full.

    • Simple custom orders must be placed no later than 7 days prior to your event.

    • Complexed custom orders must be placed no later than 14 days prior to your event. Complexed orders are:

      • any cakes, bouquets or cupcakes requiring intricate designs or any large quantity.

    • Bento Cake orders can be placed no later than 3 days prior to your event.

    • Any last minute custom orders (3 days prior to your event) depends on our availability and will incur an additional charge.

  • Cost:

    • Free

    Pickup Window:

    • All custom orders must be picked up in the time frame indicated below:

      • Tuesday - Sunday between 5:00 pm - 7:00 pm

    Pickup Requirements:

    • Message when you are on your way to ensure your order is boxed and ready to go when you arrive. 

    • Please call or text when you arrive and allow us 10 mins to bring your order to you.

    • Please plan to arrive no later than the stated pickup window.  

    Note:

    • We can not guarantee availability once your pickup window is closed and a refund will not be issued.

    • A 30 min grace period will only be offered if you notify us before your pickup window is closed.

    • La Gâterie SXM assumes no responsibility for damages incurred after self-pickup.

    Pickup Recommendations:

    • Arrive with an air-conditioned vehicle

    • Place orders on the floor of the vehicle

    • Do not place orders on someone’s lap or on car seats

    • Do not place in the trunk

    • Do not spend extended periods in a vehicle without A/C

    • Do Drive cautiously​

    Pickup Exceptions

    • Pickups can be made outside of the pickup windows mentioned based on a case by case scenario.

    • In case of an emergency please contact us as soon as possible and other arrangements may be made.

      Note: A charge may be incurred depending on the resolution.

  • Cost:

    • Delivery cost is based on the proximity to our location in French Quarter

      • French Quarter: Free

      • Grandcase, Marigot, Sandy Ground and surrounding areas: €5

      • Dutch Quarter, Philipsburg, ColeBay and surrounding areas: €5

      • Maho, Cupecoy, Lowlands, Baie Nettle and surrounding areas: €10

    Delivery Window:

    • All custom orders can be delivered in the time frame indicated below:

      • Tuesday - Friday between 10:00 am - 12:00 pm

      • Saturday - Sunday between: 5:00 pm - 7:00 pm 

    Delivery Requirements:

    • Provide your (Pinned) location via WhatsApp or detailed instructions

    • Clear communication is needed prior to and during the delivery window to ensure a smooth delivery.

    Note

    • Last minute address changes must be notified 24hours in advance.

    • The delivery window does not guarantee receiving your order at any exact time within the window.

    • We will notify you once we are on the way to your location.

    • We will allow a 10 minute window to collect your order once we have arrived to your location

    • After the 10 minute window closes, we can not guarantee availability and a refund will not be issued.

    • La Gâterie SXM assumes no responsibility for damages incurred once your order has been delivered.

    • For large orders that exceed our regular capacity we reserve the right to charge extra. We will contact you with a quotation for your approval should this be the case.

    Delivery Exceptions:

    • Deliveries can be made outside of the delivery windows mentioned based on a case by case scenario and may incur an additional charge.

    • Last minute address changes can be made but will incur additional charges depending on the location.

    • All additional charges must be paid on delivery in order to receive the order.

    • At La Gâterie SXM, we do not require a deposit for inquiries. Once your order is reviewed and accepted you will have 24 hours to make a full payment. All payments can be made via wire transfer, cash or credit card payment link that will be provided.

    • Note : If payment is not received within the 24 hour window, your order will be cancelled and will have to be resubmitted. Order acceptance will be based on availability.

    • All prices are quoted in EUR and exclude delivery costs unless otherwise stated.

    • We accept payment by Cash, Credit Card (MasterCard, Visa, Discover, Apple Pay, Google Pay, American Express, Visa Electron, and Maestro) and Wire Transfer . Note: A 2.5% fee will be added to all credit card payments.

    • When using a credit card you confirm that you are the cardholder or have permission to make payment with the card by the cardholder. In the event that our system flags an issue with the provided card, we will refund the order and contact you to take payment with an alternative payment method. Should this not be possible we will not accept the order.

    • We reserve the right to change/amend prices at any time at our discretion before, but not after, we accept orders.

  • You can always cancel your order with us. Receiving a refund when you cancel your order will depend on what you have bought, whether there is anything wrong with it and when you decide to cancel your order:

    • Once your payment is received you have 48 hrs to cancel and get a full refund.

    • Any cancellations after 48 hrs of your order will be non-refundable.

    • All last minute orders are non-refundable.

    • Taste is based on personal preference. Refunds will not be given if the client does not like the taste of the product.

    • We can replicate, but we do not promise to duplicate exactly like any design, colors, baker, or picture. Refunds will not be given if the client is not satisfied with the outcome of the design.

    • Any Color, Flavor or Text not matching your order request must be identified at the time when the order is collected/received. We will do our best to correct the color, flavor or text at that time if possible.

    • If the client does not wish to accept the product upon delivery or pickup, there will be no refund given, unless the cake is completely damaged by La Gâterie SXM

    • If for any reason La Gâterie SXM is unable to fulfill your order by the event date a refund will be issued.

    • If a refund is required, the refund will be issued within 7 business days.

      How to cancel your order:

    To cancel your order, please email us at info@lagateriesxm.com or send a whatsapp message +590 690 079442. Please provide your name and details of the order. Any order cancellations must be made in written form and confirmed by us to be considered valid.
